PHARA Responds to Docks & Boathouses Self Registration

The following letter was emailed by the Pender Harbour and Area Residents Association on Thursday, September 19, 2024 to Nathan Cullen, Minister of Water, Land and Resource Stewardship, Deputy Minister Lori Halls and Premier David Eby. As of October 9, PHARA had not received a response.

Dear Minister Cullen, The Pender Harbour and Area Residents Association (PHARA) has been contacted by a number of our members that have received emails stating as follows:

Subject: Existing Dock and Boathouse Self Registration Live

Good morning,
You are receiving this email as an interested party of the shíshálh swiya Dock Management Plan updates. The Province and shíshálh have released the shíshálh swiya self-registration system for existing tenured and untenured private moorage
docks and boathouses within the shíshálh swiya. Please self-register now to receive a General Permission for your existing structure.

Should you wish to remove yourself from this distribution list and not receive further updates on the shishalh swiya Dock Management Plan, please respond to this email directly requesting your removal.

PHARA is not aware of any legal obligation for residents to provide this registration. Can you please advise if the province takes the position that the registration is voluntary or mandatory (and if the latter, the legal basis for same)? 

Can you please also clarify: 

  • what exactly is the “General Permission” referred to?
  • will registrants receive something issued under the Land Act (or another law) and, if so, please clarify what provisions?
  • is the province requesting this registration in respect of persons that already hold authorizations under the Land Act?
