B.C. Government Files Sparse Response to DRIPA Constitutional Challenge

After some delay, the B.C. Government has finally filed its Response to the Pender Harbour and Area Residents Association’s (PHARA) constitutional challenge to DRIPA. A copy is attached below. The filing is remarkably sparse—just two pages compared to our 42-page submission.

We are continuing to advance this case with the support of those who have donated through our GoFundMe page: GoFundMe – Constitutional Challenge, and we hope to have it heard in the B.C. Supreme Court later this year or in early 2027.

We do not believe that minor potential amendments to DRIPA (shared only with First Nations leaders and leaked to the media) will be sufficient—even if passed—to address the constitutional problems identified in our claim. DRIPA, in its entirety, must go.
